1. Acceptance

By creating an account or using the Services you confirm that you have read these Terms of Use, including the investment disclaimer in section 9, and agree to be bound by them. If you do not agree, do not use the Services.

Yard Charts scans markets with automated, rule-based algorithms and issues Alerts when one of its chart patterns is detected. What you receive depends on your plan:

Alerts are generated by software from market data supplied by third parties. Coverage, markets and features may change as the Services evolve; the current details are always on the Pricing page.

4. Your account

• You choose your own username and password and must keep them confidential.
• An account is for one person. Do not share your login or let others use your account.
• Give accurate registration details and keep them up to date.
• Tell us straight away at support@yardcharts.com if you think someone else has accessed your account.

5. Plans, free trial and payment

• The Free plan costs nothing, needs no card and does not expire.
• Standard and Premium are paid in advance for the billing period you choose: 1, 3 or 6 months. Current prices are shown on the Pricing page.
• Free trial: paid plans start with a 7-day free trial. When the trial ends you are billed for the plan and period you selected, unless you cancel before the trial expires.
• Automatic renewal: at the end of each paid period your subscription renews automatically for the same period, and you are billed again at the price then in effect, unless you cancel before the renewal date.
• A price change applies only to billing periods that start after the change.

6. Cancellation

You can cancel a paid plan at any time from your Profile, or by asking us at support@yardcharts.com. To avoid the next charge, cancel before the trial ends or before your renewal date.

• During the free trial: cancel before the 7 days are up and you will not be billed.
• During a paid period: your plan stays active until the end of the period you have already paid for, and it will not renew.
• When the paid period ends, your account continues on the Free plan.

7. Refunds

Payments for a billing period that has started are not refundable, in full or in part, and all sales are final. This does not affect any rights you have under the consumer law that applies to you.

8. How you may use the information

The Services are for your personal, non-commercial use. You may view, store, analyse, reformat and print the information for yourself.

You may not publish, sell, redistribute or share Alerts or other content, give others access to it, or use it in any business, including securities, investment, accounting, banking, legal or media activities, without our written permission. You may not scrape, copy or reverse-engineer the Services.

10. Availability

We make commercially reasonable efforts to keep the Services available and to restore them promptly after an interruption. We do not guarantee that they will be uninterrupted, timely or error-free, and Alerts may be delayed or missed because of data, network or system issues.

11. No warranties

The Services and all content are provided “as is” and “as available”. To the extent the law allows, we give no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or accuracy, and we do not warrant that the Website is free of viruses or anything else that could harm your devices or networks.

12. Limitation of liability

To the fullest extent permitted by law, Yard Charts and its affiliates are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, trading losses or loss of data, arising from your use of, or inability to use, the Services or any Alert. Where liability cannot be excluded, it is limited to the fullest extent the law allows. Any claim must be brought within one year after the cause of action arises.

13. Your personal information

We collect and use information about you to run your account, manage access, produce statistics, improve the Services and, where permitted, for marketing. You can ask to see or correct your personal data by writing to support@yardcharts.com. We may charge a reasonable fee where the law allows. Our use of cookies is explained in the Cookie Policy.

14. Suspension and termination by us

We may suspend or close your account immediately, without notice, if you breach these Terms, or if we stop providing the Services. If we stop providing a paid plan you have paid for, we will tell you how the remaining period will be handled.

15. Indemnity

You agree to compensate Yard Charts for any loss, damage or cost, including reasonable legal costs, arising from a third-party claim connected with your use of the Services in breach of these Terms.

16. General

• Assignment: you may not transfer your rights or obligations under these Terms.
• Severability: if any provision is found invalid, the rest remain in force.
• Changes: we may update these Terms. We will post the new version on the Website with a new “last updated” date and try to notify you by email. Continuing to use the Services after a change means you accept it.

17. Governing law

These Terms, and any dispute arising from them or from your use of the Services, are governed by the laws of Italy. If you are a consumer, this does not take away any protection you have under the mandatory laws of the country where you live.
